Cobb County accident report stated that on March 6, 2015 both vehicles were pulled over into the Wendy’s on S. Cobb Drive, SE. Driver 1 stated that he was in the right turn lane, about to make the right turn onto SB S. Cobb Drive from Windy Hill. He stated that he hit the brake to stop behind Vehicle 2, but his vehicle did not stop, the brakes failed. Driver 2 advised that she was sitting at the red light in the turn lane, waiting to turn SB onto S. Cobb Drive. The light was green to turn, and as she lifted her foot from the brake and that is when Vehicle 1 struck her vehicle. Neither party was injured and Driver 1 was cited for following too closely. Note: When one’s brakes fail to work properly, that driver is responsible for his vehicular maintenance and proper operation of his/her vehicle.
